Rental Agreement


The following agreement is used to finalize details of a rental between the timeshare renter and the timeshare owner or a vacation renter and the property managment company. It conforms to resort policies and is designed to protect both the owner and renter from financial loss.

4. Term:

The Guest agrees to rent the Unit from the Owner and the Owner agrees to lease the Unit to the Guest for the period specified below. The Guest may use the Unit during the term without interference subject to the terms of this Lease and the rules and regulations as set forth by the Resort. No pets are allowed. Maximum occupancy for the designated unit is____ persons.

The Guest agrees to pay the rent set forth in this paragraph and at the times stated in this paragraph. Upon receipt of the deposit the Owner shall, within 48 hours of receipt of deposit, make and confirm via email a reservation for the unit at the resort. If a reservation cannot be made during this time the Owner shall refund the full deposit to the Guest. The Owner assumes no liability for any subsequent consequences of not being able to finalize a reservation based upon the receipt of the deposit.


The balance of the rent is due on or before thirty one days prior to the start date of the term as stated in paragraph four and the due date specified above. Immediately upon receipt of the full rent payment, the Owner will notify the resort manager in writing that the Guest will be occupying the Unit during the stated term. At the same time, a copy of the confirmation letter will be sent by the Owner to the Guest.


6. Cancellation.

The Guest may cancel this agreement and the right to rent the unit for the stated term by notifying the Owner via e-mail before the date the balance of the rent is due or before forty-five days prior to the start date of the term as stated in paragraph 4 (this is the cancellation deadline as stated in paragraph 5). If the confirmed reservation is made within forty-five days of the start date of the term as stated in paragraph 4 then the Guest may cancel this agreement within forty-eight hours of obtaining a confirmed reservation (this is the cancellation deadline as stated in paragraph 5). The Guest shall receive a refund of all monies paid minus Fifty Dollars to cover administrative costs.


If the balance of the rent due is not received by Owner on or before the due date specified in paragraph 5 and the Guest has not notified the Owner via e-mail of his intention not to rent the unit the Guest shall forfeit the deposit, any other monies paid, and the right to rent the unit based on the terms in this agreement.


Cancellations cannot be made after the cancellation deadline. No refund of monies paid by the Guest under the terms of this agreement shall be refunded in the event of a failure of the Guest to occupy and use the unit for the stated term.


7. Subleasing.

The Guest may not sublease the Unit or assign this agreement without the Owner's and the Resort's prior written consent. No other person shall occupy the unit other then the Guest, the Guest's family, and the Guest's guests as listed in appendix A. Guests of the Guest may only occupy the unit along with the Guest and not alone. The Guest assumes liability for all persons occupying the unit along with him or her.


8. Additional charges.

The Owner will pay maintenance fees and all utility charges other then the telephone charges for the designated Unit.


The Guest will pay for telephone calls from the Unit (if available), any housekeeping services for which there is an additional charge, and any other extra charges (except utilities as described above) imposed by the resort for services or for the use of its facilities. If requested at time of registration, Guest will sign a credit card charge slip to secure payment for any such additional charges as may be incurred.

    The Guest will also pay a 2% lodging tax imposed by the government of Mexico at the time of checkout. The fee is usually calculated based on the annual maintenance for the unit and is estimated to be between $5.00 (USD) and $15.00 (USD) depending upon the unit.


    9. Maintenance and Condition of the Unit.

    The Guest agrees to maintain the Unit in the same condition as it is at the start of the Lease term except for ordinary wear and tear. The Guest will pay for all repairs, replacements and damages caused by the act or neglect of the Guest, the Guest's household members or guests. If requested at time of registration, Guest will sign a credit card charge slip to secure payment for any such repairs, replacements or damages.


    10. Liability.

    The Owner is not responsible for any inconvenience, including but not limited to an inability to occupy the unit, due to interruption of services due to repairs and improvements, weather, disasters, or for any other reason beyond the Owner's control.


    11. Notices.

    All notices and correspondence must be sent to the addresses, e-mail addresses, and fax numbers set forth in paragraphs 1 and 2 of this agreement.


    The parties have signed their names below on this _______ day of _________________, 200__, to evidence their agreement to the terms and conditions of this agreement.
